Victory Pharma to pay $11.4 Million in Whistleblower Case

An $11.4 million settlement resolved a whistleblower lawsuit against Victory Pharma, a specialty pharmaceutical company headquartered in San Diego.  The company was accused of promoting its drugs by paying kickbacks to doctors to induce them to write more prescriptions.  The kickbacks included everything from tickets to sporting events to concert tickets to spa outings and more.

The settlement resolves federal civil and criminal liability claims stemming from the company’s marketing of Naprelan, Xodol, Fexmid and Dolgic.

Under the agreement, Victory Pharma entered into a deferred prosecution agreement and paid a criminal forfeiture of $1.4 million to resolve federal Anti-Kickback Statute accusations, and paid $9,938,310 to resolve False Claims Act allegations.
